Supreme Court to Review Life Sentences for Juvenile Offenders

In 2005, the Supreme Court outlawed the death penalty for juveniles. This week the Court announced it will review whether sentencing a juvenile to life without possibility of parole is cruel and unusual punishment. The justices will consider two cases from Florida that challenge the constitutionality of the life sentences imposed. According to a 2008 Human Rights Watch report, there are 2,484 juveniles that have received such a sentence, with the majority concentrated in the states of California, Florida, Louisiana, Michigan, and Pennsylvania.

Reducing Sexual Abuse in Juvenile Facilities

The National Council on Crime and Delinquency has published a Special Report examining incidences of reported sexual abuse in juvenile correctional facilities collected from national and selected state and local data. This report also provides recommendations on how to "reduce youth violence and sexual assaults in troubled youth corrections systems..."

PREA Training for Juvenile Justice Practitioners

Personnel tasked with the supervision of offenders in juvenile facilities will want to attend this timely training. Behind Closed Doors: Preventing, Responding to, Investigating and Prosecuting Sexual Abuse in Juvenile Justice Facilities examines the impact the passage of the Prison Rape Elimination Act (PREA) has had on juvenile justice facility operations. Over the three-day training, participants will gain the tools and resources necessary to promote an environment free of sexual assault and intimidation. Participants will also learn the proper investigative and prosecutorial protocols to employ when such incidents do occur.This training is being presented by the Texas Juvenile Probation Commission.

Juvenile Sexual Violence Data Released

The Bureau of Justice Statistics has released a Special Report, Sexual Violence Reported by Juvenile Correctional Authorities, 2005-06. Of the more than 2,000 allegations of sexual violence reported each year, approximately one in five was substantiated, a rate higher than was found in adult prisons and jails.

Juveniles in Adult Jails

The Campaign for Youth Justice has published a November 2007 report, "Jailing Juveniles: The Dangers Of Incarcerating Youth in Adult Jails in American", that highlights the negative impact of incarcerating youth in adult jails and prisons. This report also lists pre-trial detention laws by state. They would like to see state and counties:

Update state statutes to prohibit the placement of youth in adult jails
Promote placement of youth in juvenile justice facilities as a alternative to adult jails for youth charged as adults who may need to be detained pre-trial
Implement "model approaches" to removing youth from jails
Initiate new data collection efforts and research on youth in the adult criminal justice system
